This Agreement is between Synthfy LLC, a Texas limited liability company ("Company," "we," "us," "our"), and the individual or entity accessing or using our services ("Customer," "you," "your").
Welcome to Synthfy LLC. These Terms of Service ("Terms") govern your access to and use of our AI phone answering service, AI automation platform, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
Synthfy provides AI-powered phone answering, appointment scheduling, call transcription, SMS follow-up, workflow automation, and related business automation services. Our AI assistant answers calls on your behalf, books appointments, captures leads, and sends automated communications. Synthfy is a fully automated SaaS product with no human-driven services — all call handling is performed by AI.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Subscription Plans and Billing
Synthfy LLC offers subscription plans as listed on our Pricing page. By subscribing, you agree to the following:
- Subscriptions are billed monthly on the date of signup
- A 14-day free trial is available for new accounts — no credit card required
- After the trial, your selected plan will activate and billing will begin
- You may upgrade, downgrade, or cancel your plan at any time
- Downgrades and cancellations take effect at the end of the current billing cycle
- Prices are subject to change with 30 days advance notice
- All payments are processed securely through Paddle, our authorized payment processor (Merchant of Record)
5. Refund Policy
We want you to be satisfied with our service. Our refund policy is as follows:
- You may cancel during the 14-day free trial at no cost
- If you cancel within 7 days of your first paid subscription charge, you are eligible for a full refund
- For annual plans, pro-rated refunds may be issued for the unused portion after the 7-day window
- Monthly subscriptions are non-refundable after the 7-day refund window
- Refunds for billing errors or extended service outages are handled on a case-by-case basis
- To request a refund, contact us at support@synthfy.us
- Approved refunds are processed within 5–10 business days via Paddle to the original payment method
6. Cancellation
You may cancel your subscription at any time through your account dashboard or by contacting support@synthfy.us. Upon cancellation:
- Your service continues until the end of the current billing period
- No further charges will be applied
- Your data will be retained for 30 days, then permanently deleted
- You may reactivate your account within 30 days without losing data
7. Payment Processing
All payments for Synthfy LLC subscriptions are processed by Paddle.com Market Limited (for customers outside the USA) and Paddle.com Inc. (for US customers), acting as our Merchant of Record. Paddle handles all billing, invoicing, tax collection, and payment processing on our behalf. By subscribing, you also agree to Paddle's Terms of Use and Privacy Policy.
8. Acceptable Use
You agree not to use Synthfy for any unlawful purpose, to harass or spam callers, to violate any applicable laws or regulations, to transmit malicious code or interfere with our systems, to impersonate any person or entity, or to use the Services in any manner that could damage, disable, or impair our infrastructure.
9. Intellectual Property
All content, software, technology, and materials provided through the Services are owned by Synthfy LLC or its licensors and are protected by intellectual property laws. You retain ownership of your data and content uploaded to our platform. You grant Synthfy a limited license to use your data solely to provide and improve the Services.
10. Service Availability
Synthfy strives to maintain 99.9% uptime for our Services. However, we do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance. We are not liable for any downtime, interruptions, or service disruptions beyond our reasonable control.
11. Limitation of Liability
To the maximum extent permitted by law, Synthfy LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid for the Services in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Synthfy LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
13. Termination
Either party may terminate the agreement at any time. Synthfy may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Services ceases immediately. Data retention and deletion follow our Privacy Policy and Data Processing Agreement.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Harris County, Texas.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or through our website at least 30 days before they take effect. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
